In the Circuit Court of the State of Oregon for the County of Multnomah W.W. Chapman Plaintiff vs Jas. H. Wilbur Defendant The Defendant above named for his answer to the Complaint of the Plaintiff filed herein Denies that the Plaintiff is the owner in fee or otherwise of that certain tract of land described in the Complaint and known as Block number Two hundred and Twenty Four (224) in the City of Portland County of Multnomah and State of Oregon and denies that plaintiff has any interest in Said Block whatever Denies that plaintiff is entitled to the immed -iate possession, or to any right of possession therein whatever. Defendant admits that he is in possession of Said Block but he denies that he wrongfully and unlawfully or wrongfully or unlawfully withhololds withholds the Same from plaintiff to this great damage or otherwise in the sum of five hundred dollars or any other Sum whatever. Denies that by reason of any act or acts of defendant the plaintiff has been damaged in the Sum of five hundred dollars or any sum whatever. And for a further and Separate answer and defense to plaintiffs complaint defendant alleges that he is the owner in fee of the Said Block No 224 described in the Complaint and that plaintiff has no right whatever in or to said premises or any title thereto. And defendant further answering Said Complaint and for a further defense and bar thereto alleges that on the Sixth day of November 1869 the plaintiff herein W.W. Chapman filed a Complaint in this court against this defend ant wherein Said Plaintiff claimed that he was the owner in fee of Said premises to wit Block No 244 and that this defendant was wrongfully in the possession thereof that this defendant appeared and answered Said Comp- -laint, and claimed that he was the owner of Said Block. What in Said action or suit the title in fee Simple to said Block mentioned and described herein was put in issue and adjudicated and the question put in issue and passed upon and adjudicated therein was whether the plaintiff therein Said W.W. Chapman plaintiff herein, or the defendant therein who is now defen -dant herein was the owner of and entitled to the estate in fee Single of the Said Block No 224 which is the Same property described herein; and that Such proceedings were had that on the 29th day of July 1871, this court by decree therein then and there duly rendered adjudged and decreed that this defendant was the owner in fee of Said premises That there upon Said plaintiff appealed from Said decree So entered as aforesaid to the Supreme Court of the State of Oregon and that upon Said appeal Such proceedings were had in Said Supreme Court that on the fifth day of August 1873, it was ordered adjudged and decreed by Said Supreme Court that the judgment and decree so rendered in this Court be in all things affirmed, and this defend -ant alleges that Said judgment decree is in full force and unreversed and defendant claims the Same as a full and Complete bar herein Wherefore defendant prays Judgment for his costs and disbursements and that he may go hence without day.
