Abstract

This article explores the use of genetic testing in sports before the passage of the Genetic Information Nondiscrimination Act of 2008 (GINA) and the effects that GINA will have on such testing. Part II of the article examines the importance of genetic information and genetic testing. Part III discusses Major League Baseball’s use of genetic testing to verify the age and identity of Latin American prospects. Part III also examines the National Basketball Association’s proposed use of genetic testing on a player, Eddy Curry, to rule out hypertrophic cardiomyopathy. Part IV explores the reasons GINA was enacted and the protections it offers. Lastly, Part V analyzes the effect that GINA will have on genetic testing in sports.
